A petition for Judicial Separation is sometimes used for religious reasons, moral or ethical grounds. Alternatively, unlike Divorce proceedings, you can apply for Judicial Separation if you have been married for less than a year and want to quickly proceed with an application.

The effects of Judicial Separation are:

1)         The spouses are no longer obliged to live together

2)         The Court can exercise its powers to divide the matrimonial property

3)         The decree operates like a divorce in terms of its effects on a Will
