Parental Responsibility

A Mother automatically has Parental Responsibility, but unless the Father is registered on the birth certificate (from 1st December 2003); obtains parental responsibility via agreement with the mother; or an order from the Court, it is not an automatic right.

Parental Responsibility is ‘all the rights, duties, powers, responsibilities and authority which by law a parent of a child has in relation to the child and his [her] property’. Therefore, any major decision relating to education, health or religion, for example should be discussed with the other parent.

If you do not have Parental Responsibility and wish to consider your options in gaining this by way of agreement or court order, we are here to guide you through the process.
